General Terms and Conditions (GTC)

MVP Sports AG

1. Scope

These General Terms and Conditions (GTC) apply to all orders, deliveries and services of MVP Sports AG , Riedstrasse 5, 6330 Cham, Switzerland (hereinafter "MVP Sports"), via the online shops www.thehockeyshop.ch and www.mvpsports.ch .

Any differing terms and conditions of the customer will not be recognized unless MVP Sports expressly agrees to their validity in writing.


2. Offer and conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer , but rather a non-binding invitation to place an order.

By submitting the order, the customer makes a binding offer to purchase the goods contained in the shopping cart.

The purchase agreement only comes into effect when:

  • MVP Sports has expressly confirmed the order, or

  • the goods are shipped .

Automatic order confirmations are for informational purposes only and do not constitute acceptance of the contract .


3. Prices and payment terms

All prices are quoted in Swiss francs (CHF) and, unless otherwise stated, include statutory VAT .

Any additional shipping costs will be shown separately during the ordering process.

Available payment methods are displayed in the online shop. MVP Sports reserves the right to exclude certain payment methods.


4. Pricing errors and technical errors

Despite the utmost care, price information, product descriptions or availability may be incorrect due to technical malfunctions, system errors or mistakes .

Orders with obviously incorrect price information , especially prices of CHF 0.– or amounts that deviate significantly from the market price, do not constitute a binding purchase agreement .

In such cases, MVP Sports reserves the right to:

  • to cancel the order, or

  • to submit a revised offer to the customer.

Payments already made will be fully refunded.


5. Delivery and Shipping

Delivery is made exclusively to addresses in Switzerland and – if offered – abroad.

Delivery dates are non-binding unless expressly designated as binding.

If a delivery cannot be made or can only be made with a delay, the customer will be informed immediately. Claims for damages due to delivery delays are excluded to the extent permitted by law.


6. Retention of title

The goods remain the property of MVP Sports AG until full payment has been received.


7. Duty to inspect and notification of defects

The customer must inspect the goods immediately upon receipt .

Defects or incorrect deliveries must be reported in writing within 5 calendar days . If the customer fails to report defects in a timely manner, the goods are considered accepted.


8. Returns and Right of Withdrawal

In Switzerland, there is no statutory right of withdrawal for online purchases.

MVP Sports voluntarily grants a 14-day return policy from receipt of the goods, provided that:

  • The goods are unused, undamaged and in their original packaging.

  • No custom-made or personalized products are affected.

The customer bears the return shipping costs unless otherwise agreed.


9. Liability

MVP Sports is only liable for damages resulting from intentional or grossly negligent breaches of duty.

Liability for slight negligence as well as for indirect damages, consequential damages and lost profits is excluded to the extent permitted by law.

Liability under mandatory legal provisions remains reserved.


10. Warranty

The statutory warranty provisions apply in accordance with the Swiss Code of Obligations (OR).

MVP Sports reserves the right to fulfill the warranty by repair or replacement .


11. Data protection

The processing of personal data is carried out in accordance with the Swiss Data Protection Act (DSG) .

Details regarding data processing are regulated in the separate privacy policy on the respective websites.


12. Intellectual Property

All content on the websites (texts, images, logos, graphics) is protected by copyright and may not be used without the express consent of MVP Sports AG.


13. Applicable Law and Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction is – insofar as legally permissible – Cham, Canton of Zug .


14. Severability Clause

Should individual provisions of these terms and conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
