Validity of the General Terms and Conditions
These general terms and conditions (GTC) apply to all goods orders placed via the MVP Sports AG website/online shop. The version of the General Terms and Conditions published on the website/online shop at the time of the order is decisive. The terms and conditions are subject to change at any time. Furthermore, unless there are provisions in the General Terms and Conditions, the relevant provisions of the Swiss Code of Obligations apply.

Contract area
In the MVP Sports AG online shop, deliveries of goods are currently only planned in Switzerland and the Principality of Liechtenstein. Orders from other countries on request.

Prices
The offer is valid while stocks last. All prices are stated in Swiss francs and include VAT. Any increase or decrease in VAT by the tax authority can be adjusted at any time.

Conclusion of contract and withdrawal
All information about goods and prices on the MVP Sports AG website/online shop is subject to change and non-binding. By ordering via the website/online shop, the customer submits a binding offer. MVP Sports AG confirms acceptance by email (order confirmation) to the customer. Only with this express acceptance is a contract concluded and the customer is entitled to delivery of the goods. If the goods ordered by the customer are not available in the desired quantity or at the price stated on the website/online shop, MVP Sports AG will inform the customer and can offer an alternative product. In this case, the contract is valid when the customer accepts the corrected order. Orders and agreements made by telephone are only valid if they are confirmed in writing or by email.

In the event of typographical, printing or calculation errors on the website/online shop, MVP Sports AG is entitled to withdraw free of charge.

payment
Payment for the ordered goods is made using the payment methods available in the online shop. Payment in advance: If payment is not made within 5 days, the order will be canceled.

Delivery/Shipping
The delivery costs can be seen in the shopping cart and/or in the check out. Goods are delivered during the opening times stated on the website/online shop, subject to availability. The benefits and risks lie with the transporter and the customer from the time the goods are handed over. Express shipments on request. The goods will be dispatched after receipt of payment by courier service or post. Claims for damages due to late delivery are excluded.

Retention of title
The delivered goods remain the property of MVP Sports AG until all claims against the customer have been settled in full.

Right of withdrawal/return
Exchanges and complaints can only be considered within 8 days of receipt of the goods and must be reported in writing. The complaint or return is registered via the customer account or by email.

The right of withdrawal can only be legally exercised if the goods are returned unused, undamaged, complete, unopened, without adhesive tape residue and in perfect original packaging. After receiving the goods returned in the described condition, MVP Sports AG will refund the value of the goods to the customer or, if requested, issue a voucher. The goods must be returned to the following address at the expense, benefit and risk of the customer:

Shipping costs already incurred cannot be refunded. For hygiene reasons, we neither take back nor exchange incorrectly ordered textiles.

For goods that have additional text on the item such as “No right to a guarantee and/or exchange for this product”, there is no right to a guarantee and/or exchange. There is no right to an exchange or refund for made-to-measure items. Customized products such as ice skates, which are sharpened at the customer's request, cannot be exchanged.

Warranty
MVP Sports AG guarantees to deliver the goods in perfect quality. If there are defects in the delivered goods, the customer is obliged to report the defects in writing within 8 days of delivery. After prior notification and return of the defective goods, the customer will receive a replacement delivery. If no replacement delivery is possible, MVP Sports AG will refund the payment made. In addition, any claim for reduction, cancellation or compensation for consequential damages is excluded, to the extent permitted by law.

Changes made by the manufacturer to the external design of the product do not constitute a defect. The images and size tables in the online shop are for illustration and information purposes only and are non-binding. The customer forfeits any defect rights if the goods are used improperly.

Law and place of jurisdiction
CH-6330 Cham is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
